1. Scope
These Terms and Conditions of Sale (the “Terms”) govern all sales of works, objects, and related products (the “Works”) offered under the name Maria de Mangop© through the website (http://www.mariademangop.com).
By placing an order, the purchaser (the “Collector”) expressly agrees to be bound by these Terms in their entirety.
2. Artistic Nature and Characteristics of the Works
The Works offered by Maria de Mangop constitute original artistic creations and are conceived as collectible objects of a limited and highly selective nature.
Each Work may incorporate olfactory compositions as an integral and structural element. Such compositions are developed through artisanal and non-industrial processes, including sourcing from monastic and specialized environments.
Given their nature:
each Work is unique or part of a strictly limited, time-bound series
no Work is reproduced once a series has concluded
variations in form, material, patina, fragrance, or intensity are inherent and intentional
Such characteristics shall not be considered defects but essential attributes of the Work.
3. Availability and Exclusivity
The Works are offered in strictly limited quantities and subject to individual availability.
Maria de Mangop does not maintain inventory or stock in the conventional sense. Works are:
either released within defined temporal collections, or
realized through individual commission within the framework of an active series
Availability is determined solely at the discretion of Maria de Mangop and communicated directly to the Collector.
4. Orders and Commission Process
Orders may be placed via the website or through direct and private exchange.
Certain Works are exclusively available through a commissioning process. In such cases:
the Collector enters into a direct dialogue with Maria de Mangop
the Work is developed within the conceptual and material parameters of the collection
timelines and specifications are confirmed prior to production
Once confirmed, all orders and commissions are final and binding.
Maria de Mangop reserves the right to decline any order or request at its sole discretion.
5. Pricing
All prices are expressed in euros and include applicable taxes, unless otherwise stated.
Due to the nature of the Works, pricing may vary depending on:
material composition
Scale
olfactory complexity
degree of customization or commission
Shipping, insurance, and handling costs are not included unless explicitly specified and are communicated separately.
6. Payment Terms
Full payment is required at the time of order confirmation, unless otherwise agreed in writing.
For commissioned Works, specific payment structures may be established prior to the commencement of production.
An order is considered confirmed only upon receipt of payment.
7. Delivery
Delivery timelines vary depending on the nature of the Work.
* For available Works, dispatch is arranged within a reasonable time frame following confirmation
* For commissioned Works, delivery timelines are established individually
Delivery is executed through appropriate and secure means, consistent with the value and nature of the Work.
Maria de Mangop shall not be held liable for delays arising from circumstances beyond its control.
8. Transfer of Ownership and Risk
Ownership of the Work is transferred to the Collector upon full payment.
Risk of loss or damage transfers upon delivery to the Collector or to a designated recipient.
9. Returns, Exchanges, and Cancellations
Due to the exclusive, limited, and often commissioned nature of the Works, all sales are final.
No returns, exchanges, or cancellations shall be accepted once an order has been confirmed and payment has been received.
10. Care, Conservation, and Use
Each Work requires appropriate care consistent with its material and conceptual nature.
Olfactory components may evolve over time in response to environmental conditions, including but not limited to light, temperature, and air circulation. Such evolution forms part of the Work and shall not be considered a defect.
Detailed care and conservation instructions will accompany each Work upon delivery. The Collector assumes responsibility for adhering to these guidelines.
11. Intellectual Property
All Works, as well as all images, texts, and content associated with Maria de Mangop, are protected by intellectual property rights.
No reproduction, distribution, publication, or use, in whole or in part, is permitted without prior written authorization.
The trademark “MARIA DE MANGOP,” all other trademarks and logos associated with the Maria de Mangop, whether registered or not, displayed on the Website, as well as the domain name www.mariademangop.com, are the exclusive property of the Maria de Mangop.
The Website as a whole, together with its constituent elements (including, without limitation, text, soundtracks, software, animations, photographs, videos, illustrations, logos, and, more generally, any distinctive signs), constitutes intellectual works protected under the provisions of the Intellectual Property Code. The Website and its constituent elements are the exclusive property of the Maria de Mangop, which alone is entitled to exercise the intellectual property rights and related personal rights therein, including trademarks, designs, copyright, and rights of publicity.
2. Sanctions
The use of all or part of the Website, including by downloading, reproducing, transmitting, displaying, or distributing it for purposes other than the Customer’s personal and private, non-commercial use, is strictly prohibited. Any breach of these provisions renders the offender liable to the sanctions provided under both the Intellectual Property Code and the Civil Code.
12. Personal Data
Personal data collected in the context of orders and communications is used exclusively for the purposes of processing transactions and maintaining a direct relationship with the Collector.
Such data is treated with strict confidentiality and is not disclosed to third parties, except where required by law.
In accordance with the Romanian Data Protection Act and European Regulation 2016/679 of 27 April 2016 (the General Data Protection Regulation, GDPR), the Customer has, at any time, the right to access and rectify their personal data, as well as the right to request its erasure, to object to its processing for legitimate reasons, and to obtain its restriction or portability, to the extent applicable. This right may be exercised by sending a request by email to Maria de Mangop. Proof of identity may be required in certain cases for security and data protection purposes. 13. Limitation of Liability
Maria de Mangop shall not be held liable for:
indirect or consequential damages
variations inherent to artisanal production
natural evolution of materials or olfactory components
The liability of Maria de Mangop is strictly limited to the value of the Work purchased.
14. Governing Law
These Terms shall be governed and interpreted in accordance with applicable law in Romania and the European Union. Any dispute arising from the application or interpretation of these GTC shall, failing amicable settlement, fall within the jurisdiction of the Romanian and EU courts.

15. Acceptance
By confirming an order, the Collector acknowledges having read, understood, and accepted these Terms without reservation.
